Repetitive orders under Section 144 is abuse of power: SC on J&K restriction

While reviewing the plea challenging the restriction of Jammu and Kashmir, Supreme Court, a three-member bench of Justices NV Ramana, R Subhash Reddy and BR Gavai told the centre that they cannot repetitively use of section 144 in the Union Territory. The top court said that a colonial-era law that prohibits large gatherings is considered as abuse of power. Section 144 cannot be implemented unless there is sufficient evidence of a threat to public safety and only can be applicable in an emergency situation.
